  4. Interesting, exactly in the struggle among the traditional position of photography as a medium in service of ‘greater’ art forms (see example by Dégas http://img.izismile.com/img/img3/20100725/640/how_famous_painters_640_02.jpg) and the current of photography being recognized fully as an independent art discipline. And while many of Dégas pictures were shot by himself, in this case the author of the original photograph is one of the most well know Dutch photographers, so the discussion regarding authorship and where art is born even more fascinating. I personally think concerning the staatsieportret that there are two births, as nobody will deny the value of both Breukel and van Dongen’s qualities. I am curious about the outcome of this discussion.

  5. Art-history appropriates artists to its own construction, and vice versa: artists appropriate theoretical and canonical elements of art historical authority to further its own development. Still to not make this an all too muddled de-authorized game that leaves us guessing who ‘writes’ what, (though in itself this is an interesting consideration) shouldn’t we take the artists intent in this as starting point? Did Van Dongen introduce appropriation or the issue of authorship into her work, and did she want to express that in this commission? And since van Breukel is a well established artist in his own right, including the recognition of his stature as artist-photographer, I think it maybe was a careless move by Van Dongen.

  6. It is interesting to realize that the outcome of this discussion will be based upon context and artist intention, and that, considering the history of art, there isn’t likely any possible ‘objective’ conclusion. If this would reach court, I would be very curious to hear what the lawyers and judge have to say.
As you well say, art history and artists are in a constant play with each other, and there are many traditional examples of use of photographs for painting purposes (van Gogh, Delacroix, Toulouse Lautrec and many others), and many other examples of appropriation in art and in other industries (what is fashion doing any differently?).
Looking at it from the other side, photographers produce constantly images inspired by painting, for the sake of art, the sake of commerce and for the sake of the in between. (See this double example http://partnouveau.com/wp-content/uploads/2013/01/John-Singer-Sargent-and-Steven-Meisel-and-Peter-Lindeberg.jpg Steven Meisel, Vogue June, 1999 followed by http://partnouveau.com/wp-content/uploads/2013/01/tumblr_ma3rwpGPZM1r56kfgo1_1280.jpeg Peter Lindbergh, Harper’s Bazaar May, 2008).
We see this practice of ‘inspiration’ almost daily in magazines, and somehow it seems less shocking than reusing a photograph for making a drawing/painting. Despite the position of photography in contemporary art, it seems very difficult for photography to escape from its condition of being ‘mechanically reproduceable’ and being subordinate to other disciplines. Specially now photography is more than ever in the public realm (“Google pictures”, quote).
Most likely, if Koos Breukel had lived 150 years ago, this discussion would not exist and Iris van Dongen’s drawing would be considered an hommage. But there is a lot of money involved, and the amount involves authorship fees and rights, and there it gets a bit misty and subjective. I guess Breukel must have been inspired himself too?

  7. I think it is not fair to put that much emphasis on the element of envy and financial consequences in this issue. I heard Breukel talk about his exhibition at the Gemeentemuseum The Hague on this particular image he made of the then Prince (I think) and the way it played a role in his oeuvre. The show was presented as installation of his numerous works, mixing all topics, styles and seizes, alongside very private photo’s of his direct family. To me this makes it an image of particular artistic valued importance to this artist. This image serves as a fragment in his artistic statement. You are right, it won’t become more Benjaminian then this: The Work of Art in the Age of Mechanical Reproduction and particular in this case the photograph. To me his complaint should be heard, simply because of the artistic value he nominates it to have and the consequences it would have on the conditions of authorship. Just as Van Dongen may claim the appropriation of this image to fit her artistic program.

  8. Anyhow…
The assignment consisted of ‘schetsontwerpen’ were based upon photographs (maybe ‘schetsontwerpen’ is too much of a word, as ontwerp implies creation and it seems to me that the jury did rather a sort of ‘style-casting’ to choose from for the definitive portrait still to come).
This specific image by Breukel was the only one whose rights had not been bought by the state. Yes, van Dongen used it literally, but was good enough to convince the jury of her craftmanship. She presented two drawings that she intented to melt into one when selected. She got an amount, Breukel wants a share (or the rights bought by the state, as in other images by him that were also used about which he is not complaining).
Beyond authorship and plagiarism, this is just a money discussion.

  10. With much respect and admiration for Breukel’s work, to me the best portrait photographer in The Netherlands and beyond.

  18. :-)
